The Rafael Soriano Foundation (the “RSF,” “we,” “us,” or “ours”) provides you with this privacy and security policy (“Privacy Policy”) because we know that you care about how your information is collected, used, shared, and retained.

This Privacy Policy outlines our handling practices and how we collect and use the Personal Data you provide during your online interactions with us. As used in this Privacy Policy, “Personal Data” means any information that can be used to identify individually a person, and may include, but is not limited to, name, email address, postal or other physical address, credit or debit card number, title, social security number, and other personally identifiable information.

We will be the controller of Personal Data that is provided, collected and/or processed pursuant to this Privacy Policy, except where otherwise expressly stated below or in a separate agreement. This Privacy Policy applies only to information collected when you access the Site https://www.catalogue.rafaelsoriano.org (the “Site”) and in email, text, and other electronic communications between you and the Site. It does not apply to information collected by:

  • us offline or through any other means, including on any other Site operated by Company or any third party; or
  • any third party, including through any application or content (including advertising) that may link to or be accessible from the Site.

We reserve the right to revise, amend, or modify this policy at any time and in any manner. We may also notify you of changes to our Privacy Policy by email.  Your use of our website and any other services provided by the RSF after such changes are implemented constitutes your acknowledgement and acceptance of these changes. Collection of Your Personal Data

We may collect the following categories of Personal Data about you when you subscribe to or otherwise interact with the Site:

  • Name
  • Title
  • Email address
  • IP addresses and other information collected passively
  • Device identifiers

We may collect these additional categories of information in the event you submit a Submission Form in connection with a request that the RSF consider an artwork for inclusion in the catalogue raisonné. 

  • Home/work/mobile telephone number
  • Postal or other physical address

Use and Processing of Your Personal Data

We will use your Personal Data only in accordance with our Privacy Policy. If you do not wish for us to continue using your Personal Data in this manner, you can request that your account be deactivated by contacting us as specified in the “Contact Us” section.

We will only process your Personal Data if we have a lawful basis for doing so. Lawful basis for processing your Personal Data includes consent, necessity (i.e. processing the Submission Form in connection with a request that the RSF consider an artwork for inclusion in the catalogue raisonné), and our “legitimate interests” or the legitimate interest of others (e.g. our users) such as:

  • Administering, personalizing, improving, or operating our business;
  • Better understanding your needs and interests;
  • Fulfilling requests you make related to the catalogue raisonné;
  • Providing you with information and offers regarding the RSF and the catalogue raisonné;

  • Protecting, investigating, and deterring against fraudulent, harmful, unauthorized or illegal activity; or

Automatic Collection

We automatically collect some information about you when you use the Site, using methods such as cookies and tracking technologies (further described below). Information automatically collected includes IP address (static or dynamic), Internet service provider, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, sections of the Site visited, number of links you click while on the Site, search terms, the files viewed on the Site (e.g., HTML pages, graphics, etc.), operating system, Site traffic and related statistics, keywords and/or other data.

Cookies and Other Tracking Technologies

When you visit the Site, cookies or other tracking technologies may be placed on your computers or mobile devices. Children

The Site is available only for those over the age of 18. The Site is not targeted to or intended for use by children under the age of 18. The RSF does not knowingly collect or use any Personal Data from children. If you are under the age of 18, do not submit any information to this Site. If we learn that we collected Personal Data from children under the age of 18, we will take steps to delete that information as soon as possible. We are not responsible for how these third-party Sites collect, use, disclose, distribute, or maintain Personal Data. 'Do Not Track' Notifications

Some browsers allow you automatically to notify websites you visit not to track you using a “Do Not Track” signal. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. Governing Law and Jurisdiction

All matters relating to the Site or this Privacy Policy and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, the Site or this Privacy Policy shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

The Site is operated in the United States. We do not intentionally target or solicit users outside of the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States and stored on servers located in the United States.
